First Order read: Farm Mortgage Interest Bill, as amended in Committee of the Whole House, to be considered.

Amendments considered.

On amendments in Clause l,

*Mr. SWART:

I wish to say a few words on the amendment proposed by the Minister. In regard to the definition of farm mortgage, we find the words “any debtor whereunder is a farmer” inserted. I do not know for what reason the Minister has amended the Bill, because as it stood, a farm mortgage was described as a “mortgage bond registered in a deeds office whereby a farm is hypothecated”. This referred to all farm mortgages and now the Minister has introduced an amendment which has changed the whole tendency, and as pointed out before during the debate, this will cause difficulty in some instances. As the Bill stands now, the tax will only apply if the owner of the farm actually farms himself— I am not talking of the subsidy now, but of the tax. We had expected the tax to be made applicable to all farm mortgages. Take, for instance, the case of a tenant: we had expected that the tenants would, as a result of the tax, also have got a little relief, as the owner of the farm would get relief on his bond. The other case is that which I mentioned last night, namely, that of the father who lets his son farm on his land, or who purchases land for his son and has a bond on the land. The father is a “sleeping” farmer. He lives in town and the son is responsible for everything. The father does not fall under the provisions of the Bill and the result is that the son who farms and is responsible for everything has to pay the full interest and possibly a higher interest. I can assure the Minister that there are many instances of this kind, as the fathers help their sons in that way. I consider that help should also be given in such cases. For that reason we were pleased that the Bill was originally drafted in that way. Now, however, such cases are being excluded. I hope the Minister will see his way to delete this amendment. I shall also be pleased to hear from him why the Bill has been amended from what it was originally.

*Mr. SAUER:

I shall be pleased if the Minister would take a small step to help farmers in connection with this Bill. The farmer is not always thoroughly acquainted with matters, and it will be difficult for him to know exactly what procedure has to be followed to get help under the Bill. Would not the Minister be prepared by means of the press to give an explanation of the Bill?

*Mr. SPEAKER:

The hon. member can raise that question on the third reading.

†Mr. NEL:

What is the definition of a private company? Under the old law, a private company had to have seven members; five of them might be bona fide shareholders and the remaining two might be merely nominal shareholders and hold but one share each.

The ACTING MINISTER OF FINANCE:

That does not arise over this amendment.

†Mr. SPEAKER:

To avoid confusion I think hon. members had better discuss only one amendment at a time.

†Mr. NEL:

It appears to me that a hardship may be inflicted. Under the new company law it is necessary to have only two shareholders in the case of a private company.

†The ACTING MINISTER OF FINANCE:

As the Bill now stands, unless all the members of the company are farmers, within the meaning of the Act, the Act will not apply to them. Whether shareholders are nominal or real shareholders it will be impossible to say. They are shareholders.

Amendment of definition of “farmer” put and agreed to.

†The ACTING MINISTER OF FINANCE:

The hon. member for Ladybrand takes exception to the amendment, because he says it limits the application of the Act to bonds given by owners who are farmers within the meaning of the Act, his contention being that the effect of the definition will be that farmers will not be relieved under this Act whom it is intended should be relieved. Without this amendment, however, the definition of “farm mortgage” would not be linked up with the definition of “farmer.” That was the intention of the Minister of Finance. Tn the white paper, hon. members will see, at the top of page 4, that—

The Government proposes to make available in the next budget enough money to enable it to pay a subsidy of l½ per cent. on the capital of mortgages of bona fide farmers. The Government expects from the mortgagees that while this support lasts they will be satisfied to limit the interest they receive on their money to 5 per cent. per annum. The farmers will, therefore, pay 3½ per cent., and, by making the subsidy contingent on their paying their share, the Government will in effect be safeguarding 5 per cent. on their money. To deal with the case of creditors who are not willing to limit their interest during the continuation of this scheme to 5 per cent., the Government proposes to levy a tax which will be equal to the amount by which the interest actually collected by them exceeds the rate of 5 per cent. per annum. The proceeds of this tax will be distributed as a further subsidy to the farmers who have actually paid it.

That makes it perfectly clear that the intention of the Act was that this taxation should be linked up with the assistance being given to farmers, and therefore should apply only to farms owned by men who come within the definition of farmers in this Act.

There are many cases such as that mentioned by the hon. member for Ladybrand (Mr. Swart) where the father still owns the land but where the son does the farming. The mortgage is in the farmer’s name. What happens in those cases? The son farms for his father and I should like to know whether he, too, comes under this definition, will he also get a subsidy?

*Mr. SWART:

No.

The Rev. C. W. M. DU TOIT (for Mr. Steyn):

I move—

In the definition “farmer”, after “assignment” to add “, and inchides the estate of any such person who is deceased”.

On consideration of the amendment which was put on the paper by the hon. member for Willowmore (Mr. Steyn), it seems to me that, while there are cases in which this ought to be allowed, it is difficult to accept it in the form proposed, because the amendment would make the clause vague; but I am willing to accept it provided the decision is left with the Minister as to whether it should come within the Act or not. I also propose an amendment—

In the definition “farmer” after “assignment” to add “and may in special circumstances approved by the Minister include the estate of any such person who is deceased”.

That the following be a new clause to follow

Clause 9:

10. Whenever any person has prior to the first day of April, 1933, ceded a farm mortgage to any other person and the cession is in securitatem debiti or the cessionary has a right of recourse against the cedent, the cedent shall not be liable to pay the cessionary any interest in excess of 5 per cent. per annum.

I move this amendment because I consider that unless this amendment is accepted a great many of these mortgages will be called up.

†The ACTING MINISTER OF FINANCE:

I am sorry I cannot accept this amendment. As hon. members will see, the object of this amendment is to reduce the interest, not as between a farmer and his bondholder, but as between the bondholder who has ceded this bond to a creditor and that creditor. The intention is to deal with the contract between the cedent of the bond and the cessionary.

On new Clause 13,

*Mr. SWART:

I want to raise an objection to the fixing of the period of two or three months as it might not be possible for the Land Bank, for some reason or other, to dispose of the matter within three months. I, therefore, wish to suggest that the Minister should introduce ari amendment in another place and that it should be left to his discretion, if necessary, to extend the period. I should like the Minister to have the right to extend the period.

†The ACTING MINISTER OF FINANCE:

Three months is the period within which the Land Bank has to decide, and they have to decide if that is sufficient time, and if they have so decided, a further period is given to pass registration. I move as an amendment—

In lines 64 and 65, to omit “date so stated” and to substitute “expiration of the said period of three months”.

It was objected that the period given might be too long. The amendment will limit it to four months in all—one month after expiration of the three months. I also move an amendment in the Afrikaans text which does not occur in the English.

On amendment in old Clause 13,

*Mr. VISSER:

Something has become clear to me in this clause which I do not think was intended by the Minister. As this clause stands now, I do not believe that the farmer who is entitled to his subsidy will get it in full during the present year. There are many cases in my constituency where farmers pay their interest on the 1st May and the 1st November, and as the clause stands now they would only get their subsidy for seven months, viz., for April, in respect of which the interest was payable on the 1st May, and for the next six months, in respect of which the interest was payable on the 1st November. The interest for the five months after the 1st November will only be payable on the 1st May, 1934, and would consequently not fall under the subsidy for this year. I am sorry that matters are being dealt with so hurriedly, and I had to consider this matter while other members were speaking, so it has only been possible for me to draft an amendment to the English text, which to my mind will solve the difficulty. My amendment will be as follows—

To omit “which fell due or was paid ’’ in lines 24 and 25 of the English text, and to delete the words “prior to the first day of April, 1934” in lines 26 and 27, and to substitute the words “for a later period as fixed”.

This to my mind will enable people who pay interest in May and November to get the full subsidy to which they are entitled. Failing this many farmers will only get a subsidy for seven months.

Mr. ROUX:

Yes, it also struck me that what the hon. gentleman has just said is the interpretation the courts will put on the section as amended. I thought it could be dealt with by saying “interest accruing during that period There are quite a number who would not get the full year’s subsidy. In the Cape in very few cases is it payable on the 31st March or the 30th November, and in most cases it is payable on the 30th June or the 31st December.

I think on first sight there seems to be something in the point raised by the hon. member for Senekal (Mr. Visser). I will go into the matter, and if I find it is necessary to amend this I will move an amendment in the other House.

It is for that reason I have drafted the resolution in this way.
