Police officer: inquiry on actions *13. Mr F J LE ROUX

asked the Minister of Law and Order:†

  1. (1) Whether the actions of a certain police officer, whose name has been furnished to the Police for the purpose of the Minister’s reply, are or were the subject of an inquiry; if so, (a) what are the circumstances surrounding this case, (b) who is conducting or conducted the inquiry, (c) what were the instructions to the persons conducting the inquiry, (d) when (i) is the inquiry expected to be completed or (ii) was it completed and (e) what is the name of the officer concerned;
  2. (2) whether any provisional reports on the inquiry are available; if so, what is the purport thereof;
  3. (3) whether the findings of the inquiry will be made known; if not, why not;
  4. (4) whether he will make a statement on the matter?
The MINISTER OF LAW AND ORDER:
  1. (1) to (3) No.
  2. (4) However, since last year, a special investigation team of the South African Police has been conducting a comprehensive investigation as a result of certain allegations about other matters, which came to their attention.

    Particulars of the allegations cannot be revealed at this stage as they may prejudice the investigation. As soon as the investigation has been completed, the case dockets will be submitted to the Attorney-General for his decision.

Stellenbosch: demolition of squatters’ huts *22. Mr A GERBER

asked the Minister of Constitutional Development and Planning:†

  1. (1) Whether he, his Department and/or the Cape Provincial Administration gave instructions in or about July 1987 for the demolition of squatters’ huts in the vicinity of Stellenbosch to be discontinued; if so, (a) why and (b) on what date;
  2. (2) whether the inspectors concerned with the demolitions have been or are to be transferred; if so, why;
  3. (3) whether he will make a statement on the matter?
†The DEPUTY MINISTER OF CONSTITUTIONAL DEVELOPMENT AND PLANNING:

This matter vests in the Administrator of the Cape Province and he furnished the following information:

  1. (1) Yes.
    1. (a) The “instructions” to the Divisional Council of Stellenbosch to discontinue the demolition of squatters’ huts are a direct result of Proclamation No 109 of 29 June 1987 in the Government Gazette in terms of which the activities and authority in respect of squatter control were transferred from the Divisional Council to the Cape Provincial Government. It cannot therefore actually be regarded as an instruction but rather as action in terms of an amendment of the act.
    2. (b) 1 July 1987 — i.e. the day following the date of the said Proclamation.
  2. (2) The transfer of inspectors was discussed as a result of the transfer of responsibilities but has not been finalised yet. The necessary arrangements (posts, etc) for transfer to the Cape Provincial Government, who received the additional activities, are at present being considered.
  3. (3) No.

Mr Chairman, arising from the hon the Deputy Minister’s reply, does the fact that he prefaced his reply by saying that the information he gave us was provided by the Cape Provincial Administration imply that he and his Minister do not accept responsibility for the correctnes or otherwise of that information?

Teachers’ association: prevention of meeting *23. Mr J VAN ECK

asked the Minister of Law and order:

  1. (1) Whether members of the South African Police prevented a public meeting arranged by a certain teachers’ association, the name of which has been furnished to the police for the purpose of the Minister’s reply, from taking place at the Samaj Centre in Rylands, Cape Town, on 18 April 1988; if so, (a) what is the name of this association, (b) what action was taken by the Police, (c) (i) by whom and (ii) in terms of what statutory provisions or regulations was this decision taken, (d) (i) on what date and (ii) at what time did the Police first learn that this meeting was to take place and (e) (i) on what date and (ii) at what time was the decision taken to prevent the meeting from taking place;
  2. (2) whether the organizers of the meeting were informed of this decision; if so, who was so informed; if not, why not?
†The MINISTER OF LAW AND ORDER:
  1. (1) Yes. This meeting was arranged to promote the selfish political aims of the WESTERN CAPE TEACHERS’ ASSOCIATION which has strong ties with the UDF and is not acknowledged as the mouth-piece of the teaching profession. The meeting was by no means in the interests of the children or education. The organisers planned to propagate a school boycott in which they would have used school children to promote their own selfish aims. By so doing, the children would have been deprived of important and essential education. The following persons, who have no interest in education, would have acted as speakers:
    ABDULHAH OMAR — an UDF office bearer;
    ANDILE JONAS of the National Education Crisis Committee;
    and an unidentified speaker of Cosatu.
    1. (a) The WESTERN CAPE TEACHERS’ ASSOCIATION
    2. (b) After consultation with officials of the Department of Education and Culture, Administration: House of Representatives and the acknowledged teachers’ association, the Divisional Commissioner prohibited the gathering. Members of the South African Police informed persons who arrived for the meeting that the gathering had been prohibited and requested them to leave. They complied with this request and no further police action was necessary.
    3. (c)
      1. (i) The Divisonal Commissioner, Western Province.
      2. (ii) Regulation 7 of the Safety Regulations, promulgated in terms of section 3 of the Public Safety Act, 1953 (Act 3 of 1953) by Proclamation R.96 of 11 June 1987.

Financial rand: transactions *2. Mr W J D VAN WYK

asked the Minister of Finance:†

(1) (a) What total amount was (i) spent in the Republic and (ii) handled by a certain bank, the name of which has been furnished to the Minister’s Department for the purpose of his reply, by means of the financial rand during the latest specified period of five years for which figures are available and (b) what is the name of the bank concerned;
  2. (2) whether consideration is being given to replacing the financial rand by the commercial rand; if so, (a) for what reasons and (b) when;
  3. (3) whether he will make a statement on this matter?

(1) (a) (i) This information is not available as the majority of transactions in Financial Rand (both purchases and sales of securities) are undertaken by non-residents on the Johannesburg Stock Exchange which transactions do not require specific Exchange Control authority issued by the South African Reserve Bank.

Privatisation of oil supplies *3. Mr C J DERBY-LEWIS

  1. (1) Whether it is the intention to privatise South Africa’s strategic oil supplies; if so,
  2. (2) whether consideration has been given to effecting privatisation in this regard by transferring control for a financial consideration; if so, what are the relevant details;
  3. (3) whether he will make a statement on the matter?

Helderberg: cargo *4. Mr D J N MALCOMESS

asked the Minister of Transport Affairs:

  1. (1) Whether he will furnish information on the cargo carried by the Helderberg at the time of its crashing into the sea near Mauritius on 28 November 1987; if not, why not; if so,
  2. (2) whether the captain of this aircraft expressed concern to the South African Airways in regard to the nature of the cargo to be carried on its last flight from Taipei; if so, who was the consignee of the relevant cargo;
  3. (3) whether any telex messages were exchanged between this captain and the Airways in regard to the nature of the cargo prior to the take-off of the Helderberg from Taipei;
  4. (4) whether he will make a statement on the matter?
The DEPUTY MINISTER OF TRANSPORT AFFAIRS:

No. The Commission of Inquiry surrounding the Helderberg air disaster has not as yet completed its investigation and the matter is therefore regarded as sub judice.

Mr D J N MALCOMESS:

Mr Chairman, arising out of the hon Deputy Minister’s reply, may I ask him whether he is not aware that when I put supplementary questions to the hon Minister on the previous occasion, he suggested that I place my questions on the question paper?

The DEPUTY MINISTER:

Mr Chairman, all I want to say to the hon member is that we have no record of any telexes between the captain of the Helderberg and the authorities beforehand. If, however, the hon member has any information which we do not have, I would like to invite him to submit that evidence to the Margo Commission.

Mr D J N MALCOMESS:

Mr Chairman, further arising out of the hon the Deputy Minister’s reply, is he aware of a report which appeared in the Press stating that hazardous illegal cargo in a disguised form may have caused the fire aboard the Helderberg and, in view of that, does he not think it would be better for a statement to be issued on the subject to clear up any possible doubt in the minds of the public as to whether or not hazardous illegal cargo was carried on the Helderberg?

The DEPUTY MINISTER:

Mr Chairman, I have nothing more to add to what I have already told the House.

Cash gratuities: equality of private/public sectors *5. Mr D J N MALCOMESS

asked the Minister of Finance:

Whether he intends to equate the private and public sector position as regards cash gratuities paid to retiring staff being exempt from tax; if so, when; if not, why not?

The DEPUTY MINISTER OF FINANCE:

The achieving of neutrality in the tax treatment of gratuities and lump sum payments received by private and public sector employees is dealt with in paragraph 8.5.4 of the White Paper on the Report of the Margo Commission.

As indicated therein the Government has accepted the Commission’s recommendation that these benefits be taxed on an equal basis, but subject to the condition that the rights of existing members of pension and similar funds be adequately protected. I also dealt with this matter in my statement of 27 January 1988.

The means by which vested rights should be protected is to be investigated by the Commissioner for Inland Revenue who will hold discussions with interested parties. Owing to the immediate heavy burden on the Commissioner and his staff in preparing legislation for submission to Parliament during the current session and the large number of other Margo recommendations that have been accepted, notably the introduction of the VAT system, and which still have to be researched and implemented, such investigation and discussions have not yet taken place. The matter will, however, receive attention during the recess.

Angola: cost of military action *6. Mr J H VAN DER MERWE

asked the Minister of Defence:†

  1. (1) What was the total cost of the military action of the South African Defence Force in Angola during the period 1 July 1987 to 31 March 1988;
  2. (2) whether this cost is being financed from the appropriation for the current financial year; if not, in what way will the cost be financed; if so,
  3. (3) whether any steps are being taken in respect of rebudgeting to finance the requirements initially budgeted for; if not, why not; if so, what steps?

(1), (2) and (3) These questions were fully replied to in the Standing Committee on Finance and were also dealt with during the debate on the Defence Vote in Parliament last week.

SADF: food wastage *7. Mr J H VAN DER MERWE

asked the Minister of Defence:†

  1. (1) Whether the South Adfrican Defence Force has received any complaints about alleged waste of food handled by its catering division; if so, what is the nature of these complaints;
  2. (2) whether these allegations have been or are being investigated; if so (a) when and (b) with what result;
  3. (3) whether the Defence Force has instituted or will institute an investigation in order to effect a saving in this connection; if not, why not; if so (a) what amount can possibly be saved and (b) what control measures for combating waste are there at present?

(1), (2) and (3) The question cannot be replied too meaningfully, as it has been put too vaguely and also states no spcific time period. If the hon member could provide the SA Defence Force with more details, this matter will be investigated.

Mr Chairman, arising out of the reply of the hon the Deputy Minister, he is aware that it is being said at the moment — and I have seen the documents about an investigation — that an amount of up to R30 000 million per annum is being squandered and that that could be avoided.

Mooi River: toll road plaza/upgrading of alternative road *8. Mr R W HARDINGHAM

asked the Minister of Transport Affairs:

When is it anticipated that the (a) toll road plaza at Mooi River will become operative and (b) upgrading of the alternative road between Nottingham Road and Escourt will be completed?

The DEPUTY MINISTER OF TRANSPORT AFFAIRS:
  1. (a) During December 1988.
  2. (b) There are no plans at present to upgrade this road. Should traffic volumes increase the road will be suitably improved and/or maintained.

Mr Chairman, arising out of the hon the Deputy Minister’s reply, is he aware of the condition of that alternate road and how important it is that the toll road at Mooi River should not be opened until the upgrading of the alternative road has been completed?

The DEPUTY MINISTER:

Mr Chairman, I would like to tell the hon member that the submission which he has just made should be made to the authorities concerned because it also affects the provincial administration in Natal, and we will certainly look into that particular issue.

Mr R M BURROWS:

Mr Chairman, further arising from the reply of the hon the Deputy Minister, is he aware that the provincial authorities in Natal have requested funds for the upgrading of this road?

Learning Technologies: Mathematics courseware *9. Mr K M ANDREW

asked the Minister of Education and Development Aid:

  1. (1) Whether, with reference to his reply to Question No 29 on 26 April 1988, the (a) IVIS interactive video system and (b) completed courseware in Mathematics for Standards 8, 9 and 10 were delivered in March 1986; if not, (i) why not and (ii) when were they delivered;
  2. (2) when was payment made in respect of the (a) system and (b) courseware;
  3. (3) whether it was possible to use the courseware in the form in which it was delivered; if not, (a) why not and (b) when was it possible to use the courseware; if so, (i) when, (ii) where, (iii) by whom and (iv) under whose supervision was it first used;
  4. (4) whether there was any (a) discussion and/ or (b) collaboration with Learning Technologies (Pty) Ltd in respect of the courseware for any other subjects; if not, why not; if so, (i) what discussion or collaboration, (ii) when, (iii) with whom, (iv) what was the result of such discussion or collaboration and (v) what payments were made in this regard?

(1) Whether his Department holds any copyright in respect of the (a) IVIS interactive video system and (b) any courseware developed for or used with this system; if not, (i) why not and (ii) who holds the copyright; if so, (aa) what copyright, (bb) since when, (cc) for how long and (dd) how much was paid for such copyright;
  2. (2) whether his Department has allowed (a) Learning Technologies (Pty) Ltd, (b) a certain body, the name of which has been furnished to the Minister’s Department for the purpose of his reply, and (c) any other specified person or organisation to supply or use any interactive video system or courseware for which it holds the copyright; if so, (i) on what conditions, (ii) who made this decision, (iii) how much is his Department being paid and (iv) what is the name of the body in question;
  3. (3) whether his Department has had any direct or indirect dealings with the body referred to in paragraph (2) of this question; if so, (a) with whom, (b) when and (c) what was the nature of these dealings;

      1. (i) The acquisition of copyright on commercial systems/apparatus or variations thereof is not customary and was therefore not considered.

      1. (aa) All courseware as specified in the contract, viz: Mathematics Std 8, 9 and 10.

      4. (dd) No additional amount was paid. The Department negotiated copyright without additional cost.

NOTE: The relevant clause regarding (1)(b) (aa) reads as follows:

  1. “6.0 COPYRIGHT OF COURSEWARE
    1. 6.1 All copyright in and to the courseware, referred to in this quotation will become the sole and exclusive property of the Department of Education and Training.
    2. 6.2 The copyright referred to in 6.1 shall, however, not extend to or cover any future, new and/or innovative courseware developed by Learn Tech.”

NOTE: The HSRC is, according to a contract with the Department, evaluating the courseware and as such has access to the courseware. Learning Technologies has informed the Department that it is testing the Department’s Std 9 and 10 Mathematics courseware on a new IBM hardware network. Communication in this regard is taking place to confirm that courseware on which the Department holds copyright be used for testing purposes only.

  1. (3) Yes, enquiries were received.
    1. (a) The Chairman and the Project Manager of the Council of the body referred to.
    2. (b) 3 July 1987 and 7 July 1987.
    3. (c) The Deputy Director: Computer Based Education was approached by representatives of the body referred to, to enquire about the Department’s approach to Computer Assisted Instruction and its attitude towards working with outside bodies. Mr Metrowich supplied the necessary information as is done in the case of all such enquiries. Since the dates referred to in (3)(b) no further enquiries were received from the body referred to. Representatives of the body referred to, viewed the system on 6 May 1987 and 13 August 1987 at the College for Continuing Training.

Pilgrim’s Rest: accommodation/meals for different race groups at hotel *11. Mr K M ANDREW

asked the Minister of Constitutional Development and Planning:

  1. (1) Whether, with reference to the reply of the Minister of Economic Affairs and Technology to Question No 23 on 3 May 1988, (a) his Department and/or (b) the Transvaal Provincial Government has issued any instructions or laid down any guidelines regarding the (i) provision of accommodation and/or (ii) serving of refreshments to visitors of different race groups at the Royal Hotel, Pilgrim’s Rest; if not, by whom were these instructions issued and/or guidelines laid down; if so, (aa) what instructions or guidelines, (bb) when, (cc) why and (dd) in terms of what statutory provision, regulation or other specified authority;
  2. (2) whether a review of such instructions or guidelines is being considered; if not, why not; if so, what are the relevant particulars;
  3. (3) whether visitors of all races are able to obtain (a) accommodation, (b) meals, (c) drinks and (d) other refreshments at this hotel; if so, since when; if not, (i) why not and (ii) who is responsible for this decision;
  4. (4) whether his Department and/or the Transvaal Provincial Government is taking any steps in this regard; if so, what steps?

This matter vests in the Administrator of Transvaal and he furnished the following information:

      2. (ii) No. The Board for Public Resorts exercises control over the Royal Hotel as part of Pilgrim’s Rest Public Resort.
        1. (aa) A resolution by the Board which provides that the dining room of the Diggers Den as well as that of the Royal Hotel be opened to the different race groups.

        3. (cc) In response to requests to meet the food requirements of the different race groups.
        4. (dd) Public Resorts Ordinance (18 of 1969).
  2. (2) Pilgrim’s Rest has, in accordance with the Cabinet decision, now been classified as a general affair and has been entrusted to the Transvaal Provincial Government. This implies that the position of Overvaal Resorts in Pilgrim’s Rest must now be re-evaluated by the Transvaal Provincial Government with a view to the future handling of the whole conservation project as a general affair.

  2. (b) The total estimated costs are R4 426 970,00 which amount includes construction work, site works, services like roads, water, sewerage, stormwater drainage and electricity as well as security measures and recreational and garden facilities.

SADF: cruelty to animals *14. Mr D J DALLING

  1. (1) What is the policy of the South African Defence Force regarding cruelty to animals;
  2. (2) what steps are taken by the Defence Force to (a) monitor and (b) prevent acts of cruelty to animals?
The DEPUTY MINISTER OF DEFENCE:
  1. (1) Members of the SA Defence Force are also subjected to the Animals Protection Act No 71 of 1962, as amended, and no provision is therefore made for a separate policy.
  2. (2) (a) and (b) Military veterinarians and nature conservation personnel are continuously on the look-out for possible cases of cruelty to animals. They also regularly deliver awareness lectures at bases with reference to the treatment of pets, as will be done during the National Pet Week from 28 May to 4 June 1988.
Military pensions: Black persons *15. Mr D J DALLING

asked the Minister of Constitutional Development and Planning:

  1. (1) What is the policy of his Department or the provincial governments regarding military pensions for Black persons;
  2. (2) whether, with reference to information furnished to the Minister’s Department for the purpose of his reply, any persons who applied for military pensions have not received them; if so, (a) how many such applications have been delayed, (b) why and (c) in respect of what date is this information furnished;
  3. (3) what steps are being taken by his Department or the provincial governments (a) to ensure that those persons eligible for military pensions receive them and (b) to facilitate the process of application and payment of military pensions to prevent undue delay;
  4. (4) whether his Department or the provincial governments will take action regarding the applications for military pensions by certain persons, whose names have also been furnished to his Department; if not, why not; if so, (a) when and (b) what are the names of these persons?
†The MINISTER OF CONSTITUTIONAL DEVELOPMENT AND PLANNING:

Neither my Department nor the Provincial Governments have any policy regarding military pensions for Black persons as no responsibility in respect of military pensions for Black persons was placed on them. If the hon member refers to war veterans pensions the reply is as follows:

  1. (1) The policy of the Provincial Governments regarding war veterans pensions is laid down in the War Veterans Pensions Act, 1968 (Act 25 of 1968).
  2. (2) No.
  3. (3) (a) The Provincial Governments have no duty to ensure that persons, who are entitled to war veterans pensions, receive those pensions, as the onus to apply for a war veterans pension rests on the person who is entitled to such a pension in terms of section 3 of the Act referred to above. As soon as such a person has applied and his application is approved officials of the Provincial Governments see to it that the pension is paid out to him at a pre-determined place and time.
    1. (b) The Provincial Governments are at present actively implementing measures in Black towns throughout the Province to make it easier for all categories of pensioners to draw their pension monies and for applicants to apply for a pension.
  4. (4) Yes, on condition that such persons are entitled to a war veterans pension and comply with all the requirements laid down by the Act.

The publishers of the periodical South were given an initial notice in writing in terms of regulation 7A(4) on 13 November 1987 that I was considering action, such notice stating the grounds of the proposed action. After written representations had been received in connection with the proposed action, a warning was issued in the Gazette. Hereafter I caused the publication to be further monitored. Subsequently it became evident to me that the publication continued with the repeated or systematic publishing of matter, which had or was calculated to have the effect, referred to in the Regulations. A further written notice, stating the grounds, was issued to the publishers. Written representations were once again received from the publishers. I considered the representations carefully, whereafter I issued on 9 May 1988 the order, whereby any further issue of South was prohibited for a period of approximately one month.

(1) No. I have not yet in terms of the National Policy for General Education Affairs Act, 1984 (Act 76 of 1984), determined the general policy for norms and standards for syllabuses, examination and certification in respect of the pre-tertiary education. Hence, I have not yet considered this possibility in the context of my power to determine general policy. Facets of this topic are currently, however, part of the syllabuses of various school subjects.
  2. (2) Yes. Since the general policy has not yet been determined.
  3. (3) No. When proposals in respect of general policy are considered it may be mooted.

Yes, in terms of the policy it is the primary responsibility of the technical colleges of my Department to train those students who are the responsibility of the Department according to the Constitution. In addition the Department renders services to students of other population groups who are admitted to advanced courses on the N4 - N6 level if institutions of the education department of the particular group do not offer the specific course and if such enrolment is acceptable to the college council and the education departments concerned. This facet of education is dealt with in accordance with Items 2 and 14 of Schedule 1 of the Constitution.

The MINISTER OF JUSTICE:

The Honourable Member is probably referring to the five prisons at Durban (Westville) which serves the greater Durban/Westville area. These prisons are officially known as the Durban Medium A, -B, -C and -D Prison and the Durban Female Prison. Information regarding these five prisons is supplied.

    2. (b) Yes. The South African Prisons Service regards every complaint of an alleged assault, no matter how petty, in a serious light. Prisoners are daily given the opportunity to lodge complaints or requests, and preventative measures, for example the re-allocation of sleeping quarters or working places, are instituted should it appear that there is reason to believe that a prisoner is threatened.

In the case of injuries which are related to complaints of alleged assault, a suitable entry is made in a complaints register and/or a register of injuries and besides the necessary medical treatment which may be administered or prescribed by the medical doctor, a departmental inquiry into the alleged assault is instituted. Where such complaint is substantiated suitable action is taken in terms of Prisons Regulation 99 in the case of minor assaults, while complaints of serious assault are reported to the South African Police without delay for investigation in order that the legal process may take its normal course.

As a result of assault by fellow prisoners in the following prisons at Durban, thirty six (36) prisoners sustained injuries of such a nature that they had to be referred to prison hospitals or hospitals outside prisons for medical attention.
