Emergency regulations: juveniles detained 50. Mrs H SUZMAN

asked the Minister of Law and Order:

  1. (1) (a) What total number of persons classified as juveniles in terms of the Prisons Act, No 8 of 1959, had been detained in terms of the emergency regulations since 12 June 1986 as at the latest specified date for which information is available, (b) in which prisons were they detained and (c) for what period in each case;
  2. (2) whether these juveniles were visited by detainee inspectors; if not, why not; if so, at what intervals?
The MINISTER OF LAW AND ORDER:
  1. (1) (a) to (c) The work involved in compiling this information would be voluminous and time-consuming and cannot be economically justified. Therefore I am not prepared to furnish this information.
  2. (2) No. I wish to point out to the honourable member that Inspectors of Detainees are appointed in terms of Sections 44 and 45 of the Internal Security Act, 1982 (Act 74 of 1982) to visit persons detained in terms of Section 29 of the said Act.
    Persons detained in terms of the Emergency regulations, receive visits from Judges of the Supreme Court of South Africa, and on request from their legal representatives, parents and/or family.
    Furthermore I wish to refer the honourable member to the reply of my Colleague the Minister of Justice to Written Question Number 232.
Deaths in police custody 55. Mrs H SUZMAN

asked the Minister of Law and Order:

Whether any persons died in police custody in 1987; if so, (a) how many, (b) what were their names, (c) on what date did each die, (d) in terms of what statutory provisons were they being held, (e) in the custody of which police station was each such person when he died and (f) what was the cause of death in each case?

The MINISTER OF LAW AND ORDER:

Yes

  1. (a) 105 persons
  2. (b) and (c) From a practical point of view and because it is not in the interests of the relatives of the persons, I am not prepared to furnish this information.
  3. (d) For a variety of reasons, inter alia —
    Murder
    Armed robbery
    Rape
    Burglary
    Attempted murder
    Fraud
    Stock theft
    Illegal possession of firearms
    Driving while under the influence of liquor
    Drunkenness
    Drug peddling
  4. (e) At several police stations country-wide.
  5. (f)
    50 persons who committed suicide;
    36 persons as a result of natural causes;
    11 persons as a result of assaults by fellow prisoners;
    8 persons as a result of gunshot wounds when they attempted to escape from custody before being locked up.

Note: In none of the 41 instances where the inquests have been completed, have the presiding officers in their findings, laid the blame on the South African Police.

The inquests have not yet been completed in respect of the remaining 64 deaths and I do not consider it to be in the interests of justice to furnish particulars regarding these cases.

Special constables trained by SAP 58. Mrs H SUZMAN

asked the Minister of Law and Order:

  1. (1) (a) How many special constables had been trained by the South African Police since 25 August 1987 as at the latest specified date for which information is available and (b) where were they deployed in each case;
  2. (2) whether any complaints against constables have been laid with the Police since 25 August 1987; if so, (a) how many, (b) what was the nature of the complaints and (c) in respect of what date is this information furnished;
  3. (3) whether any special constables have been charged with offences since 25 August 1987; if so, (a) how many, (b) with what offences and (c) in respect of what date is this information furnished;
  4. (4) how many firearms of each specified type were issued to these constables;
  5. (5) whether any firearms issued to special constables have been used in the commission of any crimes; if so, (a) how many since 25 August 1987 as at the latest specified date for which information is available and (b) what were the circumstances surrounding the use of such firearms in each case?

    1. (a) and (b) Several instances up until 12 February 1988. However, the work involved in compiling these statistics country-wide is voluminous and time-consuming and cannot be economically justified. Therefore I am not prepared to furnish this information.

Note: However, I wish to draw the attention of the honourable member to the fact that the presence of special constables in the Black residential areas, causes a great deal of antagonism among radical elements. These members are often exposed to provocation and situations of necessity. Allegations of excessive force and criminal behaviour are often made against these members out of revenge, when they consequently take action against radical and criminal elements. In some instances the allegations are well-founded, but in the majority of cases it is evident that the allegations are meant to discredit special constables in the community and with the outside world.

All allegations are carefully investigated. In those instances where it is clear that special constables have committed crimes, criminal charges are investigated against them without hesitation and their services are summarily terminated. It is brought to the attention of special constables daily that they, like any other citizens, should not act beyond the limits of the Law. They also work under the supervision of experienced police officials.

Furthermore, I wish to point out to the honourable member that the Commissioner of the South African Police and I, have irrevocably undertaken to eradicate criminal behaviour within the South African Police, and this includes the criminal behaviour of special constables.

Females detained 61. Mrs H SUZMAN

asked the Minister of Law and Order:

  1. (1) How many females (a) were detained in 1987, and (b) had been detained as at the latest specified date for which figures are available, in terms of section (i) 28, (ii) 29, (iii) 31 and (iv) 50 of the Internal Security Act, No 74 of 1982;
  2. (2) (a) how many females had been detained in prison cells in terms of the emergency regulations since 12 June 1987, and (b) how many females were being so held, as at the latest specified date for which information is available?

Internal Security Act/emergency regulations: detainees released 207. Mr S S VAN DER MERWE

How many persons detained since 12 June 1986 in terms of the Internal Security Act, No 74 of 1982, and emergency regulations had been released as at the latest specified date for which information is available?

The MINISTER OF LAW AND ORDER:

— 638 persons in terms of the Internal Security Act, 1982 (Act No 74 of 1982).

— Although unrest has decreased, the revolutionary climate remains unacceptably high and unrest-related incidents still occur.

The publication and distribution of information in respect of detentions under the Emergency Regulations can contribute to increase the revolutionary climate. Therefore, I do not consider it to be in the interest of the safety of the public and the maintenance of the public order to be party to such actions.

Emergency regulations: meetings prohibited 208. Mr S S VAN DER MERWE

Whether any meetings have been prohibited in terms of the emergency regulations since 12 June 1986; if so, how many in each police district as at the latest specified date for which figures are available?

The MINISTER OF LAW AND ORDER:

Yes, 49 meetings until 22 February 1988 in various police districts country-wide.

Emergency regulations: detainees released following court orders 211. Mrs H SUZMAN

asked the Minister of Law and Order:

  1. (1) How many detainees held under the emergency regulations had been released following court orders to that effect since the introduction of the first state of emergency in July 1985 as at the latest specified date for which information is available;
  2. (2) whether any applications for the release of detainees held in terms of emergency regulations are pending; if so, how many as at the latest specified date for which information is available?

(1) and (2) I do not consider it to be in the interest of the safety of the Republic to reveal the exact establishment of the South African Police. I am however prepared to furnish this information on a confidential and personal basis to the honourable member.

Municipal police: complaints 213. Mrs H SUZMAN

asked the Minister of Law and Order:

Whether any complaints were lodged with the South African Police in 1987 regarding the conduct of municipal police attached to any town councils; if so, (a) how many in respect of each specified town council,(b) what was the nature of the complaints in each case and (c) what action was taken by the Police as a result?

Yes

  1. (a) and (b) 569 complaints inter alia, murder, attempted murder, assault with the intent to do grievous bodily harm, theft, rape, malicious damage to property, culpable homicide, pointing of a firearm, robbery, negligent driving and driving under the influence of liquor, were reported at various police stations country-wide.
  2. (c) A case docket was opened in respect of every complaint and submitted to the Attorney-General of the area concerned after completion of the investigation to decide whether prosecution were to be instituted or not.
Security legislation: detainees 240. Mr S S VAN DER MERWE

  1. (1) (a) What total number of persons was being detained in terms of security legislation as at 31 January 1988, (b) what were their names in each case and (c) in terms of what statutory provision was each being detained;

(1) Whether, with reference to his reply to Question No 2 on 18 August 1987, the investigation into the escape of any person or persons during the confrontation between the Police and suspected ANC terrorists in Guguletu on 3 March 1986 has been completed; if not, (a) what aspects of the investigation remain to be completed and (b) when is it anticipated that the investigation will be completed; if so, what were the findings;
  2. (2) whether any persons have been arrested as a result of this investigation; if so, what are their names;
  3. (3) whether any further action is to be taken in regard to this case; if not, why not; if so, what action;

      Salaries are paid to paramedical and nursing personnel in training by the hospital authorities on a monthly basis as remuneration.

    1. (1) (i) Yes, R50 (ii) No (iii) Yes, R1 000 Remuneration is paid for 10 months from February to November.
    2. (2) No. Only a few selected senior students who render services as assistants in laboratories and with marking receive R50 per month. To one honours student this year a bursary amount of R1 000 per month is paid for services to be rendered to the University. (Remuneration is paid for 10 months from February to November.)
    3. (3) Yes. In all cases where prescribed services are not provided or cannot be provided, payment is suspended.

        In the other instance, stones were thrown at a bus. A member of the South African Police, who was a passenger on the bus, fired one round of birdshot at the stone-throwers and wounded a 22-year-old Black female.
        However, I do not consider it to be in the interests of the persons to furnish their names.

It is customary to arrange interviews with representatives of the political parties of all three Houses of Parliament. Sometimes there is not enough time available to fit in meetings with representatives of all the parties and the guest concerned is consulted on his preferences. It also happens that guests themselves ask that appointments be cancelled or altered. Alterations to programmes are thus made all the time, sometimes at the last moment. The Department does not specifically keep record of such alterations. The Department also does not keep record of the discussions with guests regarding their preferences at the arrangement of appointments.

Universities in self-governing territories: restrictions on enrolment of Whites 755. Mr C J DERBY-LEWIS

  1. (1) Whether his Department imposes any restrictions on the enrolment of White students at universities in the self-governing territories; if so, what are these restrictions; if not,
  2. (2) whether he will furnish information on whether such restrictions are imposed by the universities in question; if not, why not; if so, what are these restrictions?
The MINISTER OF EDUCATION AND DEVELOPMENT AID:
  1. (1) No. The Department has no power to impose any restrictions on the enrolment of White students at universities in the self-governing territories.
  2. (2) Yes. Although persons of all population groups are admitted as students by the universities, the councils of the universities give preference to students of the population group for which the universities were initially instituted. It is the policy of these universities that no person of another population group will be registered at the cost of a person of the population group for which the universities were instituted and who qualifies for admission.

Posts of private secretary do not exist in the Department of Foreign Affairs. The services of personnel in another occupational class in the Department, who have already served abroad are utilised in that capacity. Having served for two to four years as private secretary the personnel concerned continues with their professional careers as foreign service officers.

  1. (a) The normal procedure applicable in the Public Service is followed in (i) assessing such personnel who act as private secretary and (ii) in granting them promotion.
