Departmental boards of inquiry appointed into accidents involving the Railway Administration 326. Mr. E. G. MALAN

asked the Minister of Transport:

(a) In how many cases since 1st April, 1970, has a departmental board of inquiry into an accident involving the Railway Administration been appointed, (b) what was in each case (i) the date and place of the accident, (ii) the alleged nature of the accident, (iii) the date on which the findings were submitted to him and (iv) the date on which the findings were made public and (c) what were the findings in each case.

  2. (b) and (c) Most of the accidents included in the figure reflected in the reply to part (a) were of a minor nature. It is desired to point out that the findings of departmental boards of inquiry are confidential as in some cases disciplinary steps are taken as a result thereof.

Publications Control Board: Appeals lodged to Supreme Court and Appellate Division against decisions

Supplementary reply and explanation to Question 336, for written reply, put by Mr. E. G. Malan, and replied to on 9th March, 1971 (“Questions and Replies”, col. 442):

Question:

What are the names of the (a) publications, (b) films and (c) other objects in connection with which appeals to the Supreme Court and the Appellate Division against decisions of the Publications Control Board (i) have been allowed, (ii) have not been allowed, and (iii) are still pending.

Reply:

In my reply which was submitted to the hon. House on 9th March, 1971, I stated, inter alia, that the appeal in respect of Nos. 21 and 22 of Volume 4 of the publication “Scope” was allowed. It has now come to my notice that the appeal was not allowed and that no appeal in respect of a prohibition concerning these two publications was heard. What was considered by the Court was an application to reject a warning by the Publications Control Board that the said two publications could probably be prohibited and this application was disallowed. The judgment was given on 15th December, 1969, in case No. M.1152/ 1969 of the Cape Division of the Supreme Court.
